Abstract
This study is aiming to identify legal responsibility the government have for compensating for the loss students suffer. It has been attempting to find an answer to the following question, “What is the government legal responsibility like for compensating for the loss students suffer according to the the present laws in Iran’s judicial system, considering students’ and parents’ responsibility, as well as school authorities’ responsibility, regarding the growing rate of accidents and developing the concept of legal responsibility. This research is a descriptive one based on collecting data on cards. One of the most significant findings in this study is the responsibility based on non-guilt system, which has been fashionable in diverse legal systems, although legal systems have different views. No single theory can be found in legal responsibility bases to compensate for complete loss. However, in some Iran’s legal laws it is possible to find government’s taking responsibility in some cases. Since government’s legal responsibility has no single base, due to public responsibility and owing to a burden of government responsibility, generally, the principle of compensating for full loss claims that where there is compliance among people, a citizen because of committing a crime is considered guilty, and the opposite side due to authority, control and supervision that has on the citizen must be judged responsible since the penalty of claiming authority over others means taking responsibility for their actions, and the government on behalf or their public have to provide the compensation. What causes the government to provide compensation for students’ loss is wisdom and forethought the government should have had to maintain discipline in general education, protect students, and provide health for them. Therefore, the government is responsible for accidents happening to students.
